These Terms & Conditions govern your use of Nirantara's website and participation in our estate and legacy planning courses. Please read them before enrolling or submitting an enquiry.

1. Definitions

2. Acceptance of Terms

By submitting an enquiry form, registering for a course, or attending any session, you confirm that you have read and accept these Terms & Conditions. You must be at least 18 years of age to participate. By proceeding, you confirm you have legal capacity to enter into this agreement.

3. Course Description and Availability

Nirantara offers three educational courses in estate and legacy planning, designed for adults over 40 in Thailand. Course content is educational in nature and is not a substitute for personalised legal advice. Session formats include live group sessions and individual advisory meetings as specified per course.

Courses are available in person at our Bangkok office and, where specified, online. Nirantara reserves the right to modify session formats, dates, or facilitators where necessary, and will notify enrolled participants promptly of any material changes.

We do not offer courses in all regions and certain content may be specific to Thai legal context.

4. Enrolment

Enrolment is confirmed upon receipt of payment and written confirmation from Nirantara. Places on courses are limited. Nirantara reserves the right to decline enrolment at our discretion. Where a course is fully subscribed, we will inform you and offer the option to join a waiting list.

5. Payment Terms

6. Refund and Cancellation

7. Participant Responsibilities

Participants agree to:

8. Intellectual Property

All course content, including session materials, templates, checklists, and the capstone legacy plan framework, is the intellectual property of Nirantara. A limited, non-exclusive licence is granted to each participant to use these materials for personal estate planning purposes only. Reproduction, redistribution, or commercial use is not permitted without written authorisation.

9. Educational Nature of Courses

Nirantara's courses are designed for educational purposes. Nothing in any course, session, or material constitutes legal advice, financial advice, or tax advice. Participants are strongly encouraged to seek independent professional legal counsel before making any estate planning decisions. Nirantara does not accept liability for decisions made based solely on course content.

10. Confidentiality

Personal and financial information shared during advisory sessions is treated as confidential by Nirantara and its staff. Participants should be aware that group sessions may involve other participants who are not bound by confidentiality obligations to each other. We recommend exercising discretion regarding sensitive personal details in group settings.

11. Disclaimers

Courses are provided on an "as is" basis. Nirantara makes no representation that course content will achieve any particular outcome for any individual participant. The effectiveness of estate planning depends on many factors outside Nirantara's control, including individual circumstances, legal developments, and professional advice obtained independently.

12. Limitation of Liability

To the fullest extent permitted by Thai law, Nirantara's liability to any participant is limited to the course fee paid. We are not liable for indirect, consequential, or incidental losses arising from course participation or reliance on course content. Nothing in these terms limits liability for fraud or death or personal injury caused by our negligence.

13. Indemnification

You agree to indemnify and hold Nirantara harmless from any claims, losses, or expenses arising from your breach of these Terms & Conditions or misuse of course materials.

14. Termination

Nirantara may terminate a participant's enrolment without refund if the participant materially breaches these terms, including conduct that disrupts sessions or infringes Nirantara's intellectual property. Participants may withdraw from a course subject to the cancellation terms in Section 6.

15. Governing Law and Disputes

These Terms & Conditions are governed by the laws of the Kingdom of Thailand. In the event of a dispute, the parties will first attempt to resolve the matter informally by written communication. If no resolution is reached within 30 days, the dispute will be subject to the jurisdiction of the Thai courts in Bangkok.

16. Changes to These Terms

Nirantara may update these Terms & Conditions from time to time. The updated version will be published on our website. Continued participation in a course after the date of an update constitutes acceptance of the revised terms. Where changes are material, we will notify enrolled participants by email.
